Cosmetic Negligence

Cosmetic treatments and surgery have become increasingly common in recent years, and while most practitioners adequately advise patients of the risks and the alternatives available, carrying out cosmetic procedures correctly with the informed consent of their patients and delivering the appropriate aftercare, there are still a worrying number of cosmetic practitioners who act negligently and as a result many people suffer personal injury.

The injuries may be physical in nature; patients may have suffered disfigurement, scarring, nerve damage, infection or problems with wound healing following surgery. The psychological effects of cosmetic negligence can also be equally injurious and traumatic, with patients suffering problems with confidence and low self esteem, not to mention the distress and anguish caused by patients undergoing cosmetic treatment aimed at improvement only to find they have suffered as a result of that treatment.

Duty of Care

Many cosmetic practitioners, particularly in private cosmetic practices, are not properly qualified to administer cosmetic treatments; this explains the large number of clinical negligence claims brought against private clinics.

There are risks entailed with cosmetic practices, as with all clinical procedures, and the cosmetic practitioner should fully advise you of these prior to carrying out cosmetic treatment. If a cosmetic practitioner failed to adequately advise you of the risks entailed in the cosmetic procedure and carry out a full assessment whether a treatment is suitable for you, and the alternatives to the treatment available, you may be able to make a clinical negligence claim for compensation.
